Introduction

These detailed General Terms and Conditions (hereinafter referred to as GTC) apply to the mutually contracting parties (hereinafter referred to as the Parties). On one hand, to Beastee Ltd. as the seller (hereinafter referred to as the Seller), and on the other hand, to the Buyer, who purchases goods or services from Beastee Ltd., provided that the Buyer qualifies as a consumer within the meaning of Section 685(d) of Act IV of 1959 (Civil Code, hereinafter referred to as the CC).

The language of the contract and these GTC is English. These GTC are valid from 05th March 2024 concerning the economic relationship between the Seller and the Buyer (for ordering and purchasing on the Website), they are not applicable to previously concluded contracts and remain in force until revoked. Any terms differing from these can only be agreed upon in writing with the mutual consent of the Buyer and the Seller. By purchasing and ordering on the Website, the Buyer unconditionally accepts the terms read here. The Buyer acknowledges that, as a consequence of the completed order, a sales or delivery contract is concluded between them and the Seller.

Using the Web Store, Cart Usage, Placing Orders

Using the Web Store

The Pogo Collective web store displays available products using a catalog system. The catalog system logically divides products into multiple levels to facilitate navigation. The catalog displays product lists, and clicking on the name or image of a product leads to its detailed data sheet (product page) with essential features. The current purchase price, or the gross price to be paid by consumers, including VAT, is indicated on the information page next to the product.

 

Cart Usage

The system assists purchases with a virtual shopping cart. Registration is not required to use the cart. On the product page, after selecting the size and specifying the quantity, the product can be added to the cart using the "Add to Cart" button. Only products in stock can be added to the cart. The contents of the cart can be viewed at all times in the header of the page.

 

Removing Items from the Cart

In the header, under the cart summary, opening the "Order" link reveals the detailed contents of the cart. On the right side of each product line, items can be removed one by one using the red "X". For example, if five identical items were previously added to the cart, the red "X" button must be clicked five times to remove them.

 

Placing Orders

Two methods are available for placing orders: directly after adding items to the cart on the product page, by opening the "Order" link in the pop-up window, or by clicking the "Order" link in the cart summary in the website header. Logging in is required to place an order on the Order page.

 

Logging in with Existing Pogo Collective User ID

Users can log in to our web store using the account details provided during previous registration. By entering the email address and password in the blue bar, users can choose the "Log In" button.

 

Creating a New Registration

If there is no valid Pogo Collective registration, users can access the registration form by clicking the "Register Now with Pogo Collective" link. After completing the form, the Order page will open in a logged-in state.

 

Shipping Address, Billing Address

Packages are addressed to the shipping address provided during user account creation. This information can be modified at any time by clicking on the shipping address data on the Order page or by clicking on the "Edit" link in the upper right corner. Invoices are issued based on the shipping address information by default. If different billing information is required, the Billing Information fields must be completed.

 

Note Field

Use the Note field for order-related comments (e.g., "Please deliver the package in the afternoon"). Delivery-related comments are forwarded to GLS Courier Service for information. They will endeavor to accommodate the customer's preferences during delivery to the best of their ability, but this does not guarantee a specific delivery time.

Payment, Shipping, Shipping Fee

Customers can choose from the following payment methods:

Credit Card Payment - Payment through the Barion online credit card acceptance platform.

The ownership of the goods remains with the Seller until the full purchase price is paid. If the Customer fails to settle the purchase price by the payment deadline, the Seller is entitled to withdraw from the contract.

Shipping within the European Union is carried out by GLS Hungary Ltd. The Seller sends the package number to the Customer's registered email address on the working day of dispatch at 17:00. Based on this, the Customer can track the whereabouts of the shipment on the GLS Courier website (http://connect.gls-hungary.com/). The Customer must ensure that the shipping address provided is guaranteed for receipt of the shipment during working hours (weekdays between 8:00 and 17:00).

The delivery from the package is dispatched: EU 1 region: 3-4 working days.

The Customer or any other person specified at the shipping address is entitled to receive the delivery. Regarding the expected day and time of delivery, the Customer can coordinate with the Carrier's customer service at the latter's phone number (+36) 1 802-0265. Responsibility for the integrity of the shipment transfers to the Customer from the delivery of the shipment onwards; therefore, it is the Customer's duty to inspect the shipment upon delivery and, if any external damage is found, to:

  1. a) refuse to accept the delivery,
  2. b) draw up a report on the damage with the delivery courier and keep a copy. The Customer is obliged to report any damage to the Seller immediately in writing or by phone.

Right of Withdrawal

In accordance with Government Decree 17/1999 (XI. 25.) regarding distance contracts in Hungary, the Consumer is entitled to the right of withdrawal for sales made to consumers within the framework of distance selling as follows: The Consumer may withdraw from the contract without justification within 15 days from the receipt of the goods. In case of withdrawal in writing, it shall be considered valid if the Consumer sends their statement before the deadline expires. The Consumer is obliged to return the product to the Seller promptly and in its entirety, and the cost of return shall be borne by the Consumer. The Consumer undertakes to return the product to the Seller no later than the next working day following the declaration of withdrawal, or to take all necessary steps to return the product, such as sending the product by mail. In case of delay attributable to the Consumer, the general rules of liability for damages under the Civil Code (Ptk.) shall apply. The Seller is obliged to reimburse the amount paid by the Consumer within 30 days from the withdrawal via bank transfer. The Seller is entitled to withhold an appropriate amount from the refundable amount as compensation for damages arising from the improper use of the product and the decrease in value due to improper handling.

Warranty, Warranty Period, Guarantee

The warranty period is 6 months as prescribed by law. If the manufacturer offers warranty conditions more favorable than those provided for in this decree for consumer goods, the rights granted to the distributor under the warranty transfer to the consumer at the time of performance of the consumer contract. The warranty rights can be enforced by the owner of the product, provided that they qualify as a consumer. (Consumer: a person who enters into a contract for purposes outside the scope of their economic or professional activity - Civil Code § 685 (d) point). The warranty period begins on the day the product is handed over to the consumer.

 

Warranty claims can be enforced by presenting the warranty certificate or a copy of the invoice issued by Beastee Ltd. If there is no separate warranty certificate for the product, the invoice serves as the warranty certificate. In case of a warranty claim, the cost of returning the product to the Seller shall be borne by the Buyer.

Warranty claims cannot be enforced in the following cases:

  1. a) Non-compliance with intended use
  2. b) Improper care, lack of proper cleaning
  3. c) Improper cleaning
  4. d) Failure to immediately report discovered defects (hidden material or manufacturing defects)
  5. e) Damage or violent external impact, vandalism
  6. f) Unauthorized repairs
Other Means of Legal Enforcement

If a consumer dispute between the Service Provider and the Buyer remains unresolved after negotiations with the Service Provider, the Buyer, who is considered a consumer, may turn to the conciliation body competent according to their place of residence or habitual residence and initiate proceedings with the Body. Additionally, the Buyer may also turn to the Conciliation Body competent according to the registered office of the Service Provider. Furthermore, the following legal enforcement options are available to the Buyer:

 

Filing a complaint with the consumer protection authority,

Initiating proceedings with the Conciliation Body.

In the application of the rules related to the Conciliation Body, a consumer is considered to be the civil organization, church, housing association, housing cooperative, micro, small and medium-sized enterprise, who purchases, orders, receives, uses, or makes use of goods, or is the recipient of commercial communication or an offer related to the goods.

Return Procedure

If the Buyer returns the product to the Seller (in case of withdrawal, 15 working days money-back guarantee, and warranty return), the following steps must be taken: The Buyer is responsible for ensuring proper packaging suitable for shipping the consumer goods; the Seller shall not be liable for damages resulting from improper packaging during transportation. The shipping cost of the product is borne by the Buyer in case of withdrawal, 8 working days money-back guarantee, warranty, or extended warranty. In all cases, a copy of the invoice or the warranty card must be included.

 

Cash on delivery shipments will not be accepted by the Seller.

Retention of Ownership

The product shall remain the property of the Seller until the Buyer fulfills all primary and ancillary payment obligations in full. During this period, the Buyer may not transfer the product to any third party or otherwise jeopardize the ownership of the Seller.

Data Protection

Certain information and data are essential for order processing, fulfillment of purchases, invoice issuance, warranty, and guarantee contracts. Without them, the order may be withdrawn and deemed invalid. By using the website, the Buyer assumes full responsibility for ensuring that the provided data is accurate and corresponds to reality. The Buyer has the right of permanent access to and correction of the data provided, in accordance with current European and national laws. The Seller does not transfer personal data to third parties, except when the third party is a contractual subcontractor of the Seller (e.g., courier service) and is indispensable for the fulfillment of the purchase contract with the Buyer, or when required by law or authorities.

Newsletter

The Seller sends promotional emails (Newsletter) if the Buyer accepted the option "Subscribe to the Pogo Collective newsletter" during registration. Only the Seller is entitled to send promotional materials, advertisements, to the registered email address. By providing the Buyer's data, they consent to receiving information, advertisements, offers. The Buyer can unsubscribe from the newsletter service later by clicking on the "Unsubscribe" link at the bottom of the Beastee newsletter.

CHILDREN

Our products and services are not intended for individuals under the age of 16, and we kindly ask that individuals under the age of 16 do not provide Personal Data to the Data Controller. If we become aware that we have collected Personal Data from a child under the age of 16, we will take steps to delete the data as soon as possible.

RECIPIENTS AUTHORIZED TO ACCESS THE DATA

Except for the data processors specified in point #7, the Data Controller does not transfer the recognized data to third parties. Only the employees of the Data Controller and the designated employees of the data processors can access the recorded data. The Data Controller prepares a report on the fact of inspection, which is kept by the company for 1 year.

AUTOMATED DECISION MAKING

Free shipping The logic of the system: Shipping is free for orders above the amount specified in the contractual terms. Consequences of automated decision making on the Data Subject: Automated processing has no effect on the personal data.

RIGHTS OF DATA OWNER

The Data Subject may, at the contact details specified in point 1 of the Data Controller,

10.1 Cost of Information The Data Controller provides the necessary actions and information free of charge for the first time. If within one month the Data Subject requests the same data for the second time and the data has not changed during this time, the Data Controller charges an administrative fee. The basis for calculating the administrative fee is the hourly cost of the current minimum wage, as an hourly rate. The number of work hours used for information, calculated at the above hourly rate. In addition, for paper-based information requests, the printing cost of the response at cost price and the postage cost are charged.

10.2 Refusal of Information If the Data Subject's request is clearly unfounded, they are not entitled to information, or if the Data Controller, as the data controller, can prove that the Data Subject has the requested information, the Data Controller rejects the request for information. If the Data Subject's request is repeatedly made due to its repetitive nature – excessive, the Data Controller may refuse the request for action based on the request if within one month, for the third time, the Data Subject submits a request for exercising the rights referred to in Articles 15 to 22 of the GDPR on the same subject.

10.3 Right to Object The Data Subject is entitled to object at any time to the processing of their personal data based on legitimate interest or public authority jurisdiction. In this case, the Data Controller cannot further process the personal data unless it demonstrates compelling legitimate reasons for the processing that override the interests, rights, and freedoms of the Data Subject, or that relate to the filing, enforcement, or defense of legal claims. If the legitimacy of the objection is established, the Data Controller shall cease the data processing – including data transmission and further data collection – as soon as possible. It informs all those to whom the Data Subject's data was previously transmitted. The handling of the request is free of charge, except for unfounded or excessive requests, for which the Data Controller may charge a reasonable fee corresponding to its administrative costs. If the Data Subject disagrees with the decision made by the Data Controller, they may appeal to a court.

INFORMATION ABOUT DATA SECURITY MEASURES

The Data Controller manages data in a closed system based on the requirements of its Information Security Policy.

The Data Controller ensures default and built-in data protection. To achieve this, the Data Controller applies appropriate technical and organizational measures to:

  • regulate access to data accurately;

  • allow access only to individuals whose tasks require the data, and even then, only to the minimum necessary data for the task;

  • carefully select appointed data processors and ensure data security with appropriate data processing contracts;

  • ensure the integrity, authenticity, and protection of the data it manages. The Data Controller applies reasonable physical, technical, and organizational security measures to protect the data of the Data Subjects, particularly against accidental, unauthorized, unlawful destruction, loss, alteration, disclosure, use, access, or processing. In case of known unauthorized access to personal data or its use, posing a high risk to the Data Subject, the Data Controller promptly notifies the Data Subject. If the transmission of Data Subject data is necessary, the Data Controller ensures the proper protection of the transmitted data, for example, through data encryption. The Data Controller is fully responsible for Data Subject data processing carried out by third parties. The Data Controller also ensures adequate and regular backups to protect the Data Subject's data from destruction or loss.
COOKIE POLICY

In accordance with Section 20(1) of Act CXII of 2011 on informational self-determination and freedom of information, the following must be determined regarding cookie data management on the webshop website:

  • the fact of data collection,
  • the scope of Data Subjects,
  • the purpose of data collection,
  • the duration of data processing,
  • the possible data controllers authorized to access the data,
  • explanation of the Data Subject's rights regarding data processing.

12.1 Cookies typically used for webshops include "session cookies for password-protected sessions," "cookies necessary for the shopping cart," and "security cookies," which do not require prior consent from the Data Subjects.

12.2 The fact of data processing, the scope of processed data: unique identifiers, dates, timestamps

12.4 Purpose of data processing: user identification, maintaining the "shopping cart" records, and tracking visitors.

12.5 Duration of data processing, deadline for data deletion: c_i session: username, email address - for login authentication - deleted every 2 hours, refreshed every 5 minutes, last viewed products: deleted after 10 years, chates username: deleted after 10 years, favorite products: deleted after 10 years, php session id: deleted when the browser is closed.

12.6 Possible data controllers authorized to access the data: The Data Controller does not handle personal data through the use of cookies.

12.7 Explanation of Data Subjects' rights regarding data processing: Data Subjects have the option to delete cookies in the browser's Tools/Settings menu, usually under the Privacy menu settings.

12.8 Legal basis for data processing: Consent is not required from the Data Subject if the exclusive purpose of using cookies is to transmit communications over an electronic communications network or is strictly necessary for providing a service explicitly requested by the subscriber or user relating to the information society.

GOOGLE ANALYTICS

The Service Provider measures the website traffic data using the Google Analytics service. Data is transmitted when using the service. GOOGLE ADS

The website uses the Google Ads (formerly Google Adwords) remarketing tracking codes. Remarketing is a feature that allows the website to display relevant ads to users who have previously visited the site while browsing other websites in the Google Display Network. The remarketing code uses cookies to identify visitors. If users disable remarketing cookies, personalized offers from the website will not appear to them.

FACEBOOK

Based on the decision of NAIH, the Data Controller, as the creator of the Facebook page, adheres to predefined data management rules. There are limited options for choosing settings, thus the Data Controller has no real influence on reviewing or modifying data management. Therefore, the Data Controller is not considered a data controller regarding the Facebook page.

The data management activities performed by the Data Controller are subject to the following laws:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation, "GDPR").
  • Act CXII of 2011 on Informational Self-Determination and Freedom of Information (the "Info Act").
  • Act C of 2000 on Accounting ("Accounting Act").
  • Act V of 2013 on the Civil Code ("Civil Code").
  • Act CLV of 1997 on Consumer Protection ("Consumer Protection Act").
  • Act CXXXIII of 2005 on the Rules of Personal and Property Protection and Private Investigation ("Property Protection Act").
  • Act CVIII of 2001 on certain aspects of electronic commerce services and information society services (especially Section 13/A).
  • Act XLVII of 2008 on the Prohibition of Unfair Commercial Practices against Consumers;
  • Act XLVIII of 2008 on the basic conditions and certain restrictions of commercial advertising (especially Section 6).

RECOURSE

Any data subject may turn to the competent court, including the Metropolitan Court in Budapest, or initiate an investigation at the National Authority for Data Protection and Freedom of Information in case of alleged infringement of their personal data.
